Passenger & Fleet Service Agreement
Acceptance
By downloading, accessing, registering with, or using the LadyCab App, creating an account, requesting or confirming a booking, or using any LadyCab-related service, you acknowledge and agree to be legally bound by this Passenger & Fleet Service Agreement, the LadyCab Terms & Conditions, the Privacy Policy, and any additional policies incorporated by reference.
Before completing any booking, the LadyCab App displays estimated fares, technical fees, card-processing charges, and any applicable additional costs. By confirming the booking, you expressly acknowledge, understand, and agree that:
- Any displayed fare is an estimate only and does not represent a fixed or final price for standard SPSV taxi services;
- Except where expressly agreed under the Ladies Limousine Fixed Price Service, the final fare for standard taxi journeys is determined by the taximeter in accordance with National Transport Authority (“NTA”) regulations;
- The final fare may increase or decrease depending on time travelled, distance travelled, traffic conditions, waiting time, route selection, tolls, additional stops, or other lawful SPSV extras;
- Additional charges may apply depending on the nature of the journey or passenger requests;
- In-app electronic card payments are subject to a €1 card-processing fee per booking/order; and
- A €10 LadyCab Technical Non-Refundable Fee applies to bookings made through the LadyCab Platform.
Nature of the Service
- The Fleet Operator undertakes to provide point-to-point passenger transport services in accordance with Irish SPSV legislation and applicable National Transport Authority regulations.
- LadyCab provides booking technology, dispatch services, operational support, payment processing, communication systems, GPS tracking, emergency response features, and safety-monitoring infrastructure but does not itself own or operate the vehicles used for passenger transport services unless expressly stated otherwise.
- The transport contract for standard taxi journeys exists between the passenger and the independent Fleet Operator or Driver providing the transport service.
- LadyCab acts solely as an intermediary technology and booking platform facilitating reservations, dispatch, payment collection, and operational safety systems.
Ladies Limousine Fixed Price Service
LadyCab may offer a separate premium pre-booked chauffeur-style service known as the “Ladies Limousine Fixed Price Service.”
For this specific service only:
- The journey operates on a fully pre-agreed fixed-price basis;
- The agreed amount is confirmed before booking confirmation;
- The fare is not determined by the taximeter;
- The service constitutes a pre-booked and pre-arranged limousine/chauffeur-style transport service;
- Additional passenger requests outside the agreed booking may result in supplementary charges;
- The service operates separately from standard taximeter-regulated taxi journeys; and
- The service is intended to comply with applicable National Transport Authority limousine-service operational requirements and exemptions under Irish SPSV legislation.
LadyCab reserves the right to refuse conversion of a standard taxi booking into a fixed-price limousine service unless expressly pre-booked and confirmed through the LadyCab Platform or dispatch system.
Fees and Charges
- Any fare displayed in the LadyCab App prior to booking is an estimate only and does not represent a fixed or final price.
- Except where expressly stated otherwise for the Ladies Limousine Fixed Price Service, the final fare for all standard SPSV taxi journeys is calculated by the taximeter, based on time and distance travelled, in accordance with regulations established by the National Transport Authority (“NTA”).
- Standard taxi fares may include additional lawful charges and regulated extras, including but not limited to:
- toll charges;
- waiting time;
- route variations;
- additional stops;
- airport charges;
- luggage charges; and
- any other SPSV extras permitted under Irish transport regulations.
- The total amount payable by the passenger may consist of:
- the final metered fare;
- any applicable tolls or extras;
- a €10 LadyCab Technical Non-Refundable Fee per booking/trip;
- a €1 in-app card-processing fee applicable to electronic card payments processed through the LadyCab Platform.
- Route selection may impact the final fare. Passengers are responsible for confirming their preferred route (e.g. shortest, quickest, toll-inclusive, or toll-free route) with the driver.
- All applicable fees and charges are displayed within the App prior to booking. By confirming the booking, the passenger expressly acknowledges, accepts, and authorises all applicable charges.
Cancellation / Amendment Fee
- A €5 fee applies where a booking is cancelled or modified within 30 minutes of the scheduled pick-up time.
- Where a driver has already been dispatched, additional waiting-time charges may apply in accordance with SPSV regulations and LadyCab operational policies.
- The €10 Technical Non-Refundable Fee remains payable in all no-show and qualifying cancellation scenarios once payment has been processed.
Passenger Conduct
- Passengers must treat drivers, staff, vehicles, and other passengers with courtesy and respect and must avoid abusive, threatening, discriminatory, intoxicated, or unsafe behaviour.
- Passengers must comply with all lawful driver instructions relating to safety, vehicle operation, and SPSV transport regulations.
- Damage, excessive contamination, or soiling caused to the vehicle by the passenger or members of their party may result in additional cleaning, repair, or compensation charges billed to the registered payment method.
Safety and Monitoring
- All journeys booked through LadyCab may be monitored via GPS tracking, telematics systems, emergency-response protocols, and operational safety systems.
- The panic button within the App may connect directly to designated emergency contacts and/or LadyCab emergency-support systems.
- Passengers may request a preferred female driver where available; however, availability cannot be guaranteed at all times or in all locations.
- Vehicles may be equipped with CCTV systems for safety, incident verification, insurance, and crime-prevention purposes in accordance with GDPR and Irish law.
Complaints and Dispute Resolution
- Complaints should first be submitted to support@ladycab.ie together with the booking reference number and relevant details.
- LadyCab will endeavour to acknowledge complaints within five (5) working days and provide a substantive response within ten (10) working days where reasonably possible.
- Unresolved disputes may be referred to the Competition and Consumer Protection Commission (CCPC), the National Transport Authority, or the European Online Dispute Resolution Platform in accordance with Irish law.
Liability
- The Fleet Operator and/or Driver performing the journey remains responsible for the transport service provided.
- LadyCab is responsible solely for operation of the App, dispatch platform, payment-processing systems, and associated technological infrastructure.
- To the fullest extent permitted under Irish law, LadyCab’s liability is limited to the greater of:
- The amount paid for the relevant booking; or
- €100, except in cases involving death, personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded.
Termination
- LadyCab, the Fleet Operator, or the Driver may refuse, suspend, or terminate service where necessary for safety, misconduct, regulatory compliance, fraud prevention, or breach of these terms.
- All outstanding fees and charges remain payable for completed, dispatched, or partially performed bookings.
Governing Law
This Agreement is governed by and interpreted in accordance with the laws of Ireland. Any dispute arising from this Agreement shall be subject to the exclusive jurisdiction of the Irish courts, subject to any mandatory consumer rights applicable under Irish or EU law.
