LadyCab collects and processes personal data as necessary to operate its services, including its mobile and web applications, dispatch and telephone systems, customer-support channels, and driver-management systems. This may include contact information, journey and delivery details, GPS and telematics data, payment information, identity and licensing details, device and technical information, and recordings of calls or CCTV images.

Purposes of processing

  • registering, verifying, and managing user accounts (customer, driver, or fleet);
  • performing identity, insurance, and licensing checks;
  • enabling bookings, payments, and dispatch;
  • ensuring safety and service quality;
  • investigating complaints, incidents, or insurance claims; and

LadyCab may share data, where necessary, with insurers, regulators, An Garda Síochána, payment providers, technology partners, or other competent authorities when required by law or for the safety of users and the public.

CCTV and Recordings

LadyCab vehicles may be equipped with CCTV for security and verification. Cameras may record inside and outside the vehicle. Drivers are required to display CCTV signage on both exterior sides and to notify passengers before manually activating any recording device. LadyCab is not responsible for any personal recordings made by individual drivers outside its control and accepts no liability for any GDPR breach committed by a driver.

All calls to or from LadyCab may be recorded for quality, training, and verification purposes.

App Data and Security

The LadyCab App may collect certain technical and location data from your device to provide navigation, dispatch, and safety features. By using the App, you consent to this collection and may withdraw consent by adjusting your device’s privacy or location-services settings; disabling such features may limit service functionality.

While LadyCab takes appropriate security measures, internet transmissions are not completely private or secure, and information sent via the App or website may be intercepted or read by others, even if encrypted. LadyCab cannot guarantee absolute data security for online communications.

Third-Party Links

LadyCab’s platforms may contain links to third-party websites or services. LadyCab has no control over those sites and is not responsible for their content or privacy practices. Use of any linked site is at your own risk.

Limitations of Liability

  1. (a) For taxi or passenger services, LadyCab’s total liability shall not exceed the greater of the fare paid or €100.
  2. (b) For delivery services, liability shall not exceed the least of: (i) the cost of the delivery, (ii) the replacement value of the goods, or (iii) €100.
  3. (c) LadyCab shall not be liable for any indirect, consequential, or special loss, including loss of profit, loss of business, loss of market, loss resulting from route deviation, delay, or unavailability, even if advised of such possibility.
  4. (d) LadyCab shall not be liable where loss or damage results from an unavoidable event despite reasonable care, including accident, breakdown, or events beyond its control.
  5. (e) Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under Irish law.

User Indemnity

You agree to indemnify and hold harmless LadyCab, its officers, employees, agents, and contractors from and against all claims, demands, actions, damages, costs, and expenses (including reasonable legal fees) arising from:

No Warranty and Data Transmission Disclaimer

LadyCab gives no warranty or representation as to the uninterrupted availability of its technology or communications networks. Internet transmissions may not be completely private or secure, and LadyCab shall not be responsible for interception or loss of data transmitted through the service.

3. Intellectual Property Rights

Ownership

All intellectual-property rights in and to the LadyCab name, brand, logos, trademarks, design, software, databases, platform, website content, and all related materials (collectively, “LadyCab IP”) are and shall remain the exclusive property of LadyCab Limited or its licensors. All rights not expressly granted are reserved.

User Licence

LadyCab grants each authorised user a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the LadyCab App and to access the LadyCab website and related systems solely for personal or authorised business use in accordance with these Terms. This licence does not transfer any ownership or proprietary right.

Restrictions

Users may not, and shall not allow others to:

  • copy, reproduce, modify, adapt, translate, or create derivative works from any LadyCab IP;
  • reverse-engineer, decompile, disassemble, or otherwise attempt to derive source code from any part of the App, website, or associated software;
  • remove, alter, or obscure any copyright, trade-mark, or proprietary notice appearing on or within the LadyCab platform;
  • use any LadyCab trade mark, logo, or branding without prior written consent from LadyCab; or
  • use the LadyCab platform for any unlawful purpose or in a manner likely to damage, disable, overburden, or impair any LadyCab system or interfere with another user’s experience.

User-Generated Content

Any content, feedback, or material submitted by users (including ratings, reviews, or communications) remains the property of the user, but the user grants LadyCab a world-wide, royalty-free, perpetual, irrevocable licence to host, reproduce, distribute, display, and adapt such content for the operation, promotion, and improvement of LadyCab services.

Third-Party Technology

The LadyCab App may contain components or links supplied by third-party providers such as Apple Inc., Google LLC, and Microsoft Corporation. Each of those parties retains ownership of its respective technology and trade marks. Use of their stores or systems is subject to their own licence terms.

Statutory Protection

All works, marks, and designs within the LadyCab platform are protected under the Irish Copyright and Related Rights Act 2000, the Trade Marks Act 1996, and other applicable Irish and EU legislation. Any unauthorised use, copying, or distribution of LadyCab IP may constitute an infringement and may result in civil and criminal proceedings.

Termination

Upon termination or suspension of access to any LadyCab service, the user’s right to use the LadyCab IP immediately ceases, and all copies of the App or related materials must be deleted or destroyed. Termination does not affect LadyCab’s continuing ownership of its intellectual property or any accrued rights or remedies.

4. Force Majeure

Definition of a Force Majeure Event

A Force Majeure Event means any event or circumstance beyond the reasonable control of LadyCab or the User that prevents, hinders, or delays performance of any obligation under these Terms. Such events include, but are not limited to:

  • natural disasters (flood, storm, fire, earthquake);
  • public-health emergencies, epidemic, or pandemic;
  • war, terrorism, civil disturbance, or acts of public enemies;
  • strikes, lockouts, or industrial disputes;
  • government orders, sanctions, or regulatory restrictions;
  • failure or interruption of utilities, telecommunications, or transport networks; and
  • large-scale cyber-attack, software failure, or denial-of-service incident.

Effect of a Force Majeure Event

During a Force Majeure Event, the affected party’s obligations are suspended for as long as the event reasonably prevents performance.

LadyCab is not liable for any delay, cancellation, or interruption of service arising directly or indirectly from a Force Majeure Event, and such delay shall not constitute a breach of these Terms.

Notification and Communication

The affected party must notify the other party as soon as reasonably practicable upon becoming aware of a Force Majeure Event. The notice must describe the event, its expected duration, and the mitigation measures being taken.

Mitigation and Resumption of Service

Both LadyCab and the User shall use all reasonable endeavours to reduce the impact of the Force Majeure Event and resume normal performance as soon as conditions allow. LadyCab may prioritise safety-critical operations or emergency transport services during this period.

Extended Force Majeure and Termination Rights

If a Force Majeure Event continues for more than thirty (30) days, either party may terminate the affected booking or these Terms (as applicable) by written notice, without penalty. Any amounts already due for completed or partially performed services—including € 10 Technical Non-Refundable Fee, and any € 5 Cancellation Charge incurred before the event—remain payable.

No Compensation or Damages

Except as required by mandatory Irish consumer law, no refund, compensation, or damages shall be due for non-performance or delay resulting from a Force Majeure Event.

Interaction with Other Clauses

References to Force Majeure within the Liability, Indemnity, and Disclaimers section are deemed to refer to this clause. That section should be read subject to this full definition and procedure.

Continuing Validity

All unaffected provisions of these Terms remain fully enforceable. Termination or suspension under this clause does not affect accrued rights, obligations, or remedies existing before the Force Majeure Event.

5. Governing Law and General Provisions

Governing Law and Jurisdiction

These Terms and any dispute or claim (contractual or otherwise) arising from or in connection with them, the LadyCab App, or any related service shall be governed by and construed in accordance with the laws of Ireland.

The courts of Ireland shall have exclusive jurisdiction, subject to any mandatory rights you may have under applicable consumer-protection law to bring proceedings in your country of residence.

Amendment of Terms

LadyCab may amend or update these Terms from time to time. Updated versions will be posted on the LadyCab website and/or App and will take effect upon publication or notification. Continued use of any LadyCab service after such publication constitutes acceptance of the revised Terms.

Severability

If any provision of these Terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

Assignment

LadyCab may assign, subcontract, or transfer any of its rights or obligations under these Terms without prior notice. You may not assign or transfer any rights or obligations without LadyCab’s written consent.

No Waiver

Failure or delay by LadyCab to enforce any right or provision shall not constitute a waiver of that right or provision.

Entire Agreement

These Terms, together with the Privacy Policy and any documents expressly incorporated by reference, constitute the entire agreement between you and LadyCab and supersede all prior representations, discussions, or agreements relating to the same subject matter.

Headings

Clause headings are for convenience only and do not affect interpretation.

  • to harass, stalk, threaten, or endanger any person;
  • to interfere with or disrupt the operation of the LadyCab platform or any network connected to it;

Suspension and Termination

LadyCab reserves the right to suspend or terminate any user account or access to its services at any time, without prior notice, where it reasonably believes there has been misuse, fraud, a breach of these Terms, or conduct that may harm LadyCab, its users, or the public.

Disclaimers

LadyCab strives to provide a safe and reliable service but does not warrant or guarantee that any part of its platform will be uninterrupted, secure, or free from error. LadyCab is not responsible for the acts, omissions, or conduct of any user, driver, passenger, or other third party. Use of the service is at your own risk.

Legal Compliance

All users, including drivers and fleet operators, must comply with all applicable laws, transport and safety regulations, and licensing conditions in the jurisdiction where they operate or travel. LadyCab reserves the right to report unlawful activity to the relevant authorities.

7. Data Recording, CCTV, and Tracking

Purpose and Scope

LadyCab uses recording and tracking technology to protect the safety of passengers, drivers, and the public; to verify journeys; and to assist with complaint handling, insurance, or legal investigations.

CCTV Recording

LadyCab-authorised vehicles may be equipped with CCTV cameras capable of recording video and, where permitted by law, audio.

Drivers must:

  • display approved CCTV signage on both exterior sides of the vehicle; and
  • inform passengers before manually activating any recording device not operating automatically.

Recordings made through LadyCab’s authorised systems are the property of LadyCab and may be reviewed or disclosed only for legitimate business or legal reasons.

Retention and Access

CCTV and audio recordings are retained for the minimum period necessary under LadyCab’s Privacy Policy and applicable data-protection law, then securely deleted unless required for a continuing investigation, insurance claim, or legal process. Access to recordings is strictly controlled.

Independent Recordings

LadyCab is not responsible for any personal recordings made independently by drivers, passengers, or third parties and accepts no liability for any GDPR or privacy breach arising from such unauthorised recordings. Drivers making personal recordings do so at their own legal risk.

GPS and Telematics Tracking

All active journeys and deliveries may be subject to GPS and telematics tracking for dispatch, safety, billing accuracy, and service-quality monitoring. This information may include route data, speed, time, and location stamps.

Disclosure and Use of Data

Recording and tracking data may be shared, when necessary and lawful, with insurers, regulators, An Garda Síochána, courts, or other competent authorities, as well as with users involved in an incident, for the purposes of verification, defence of claims, or legal compliance.

Policy Reference

The collection, storage, and processing of all such data are carried out in accordance with LadyCab’s Privacy Policy, available at www.ladycab.ie/privacy. That Policy forms part of these Terms and explains user rights relating to recorded or tracked information.

13. Service Fees and Charges

General Structure

All journeys, deliveries, or services booked through the LadyCab Platform are subject to:

  • the metered fare (as determined by the taximeter),
  • the LadyCab Service Fee,
  • the €10 Technical Non-Refundable Fee,
  • the €1.00 in-app card processing fee where applicable, and
  • any lawful additional charges (e.g. tolls, waiting time, route variations).

Any fare displayed in the LadyCab App prior to booking is an estimate only and does not represent a fixed or final price.

The final total payable is determined at the end of the journey based on the taximeter, in accordance with regulations set by the National Transport Authority (“NTA”), except where a fixed-price limousine service has been expressly agreed in advance under the Ladies Limousine Fixed Price Service.

Fare Estimates (Important Notice)

The amount shown to the Customer at the time of booking is provided as a non-binding estimate based on expected time and distance.

The Customer acknowledges and agrees that:

  • the estimate is for guidance purposes only,
  • the final fare may increase or decrease depending on the actual journey,
  • the taximeter is the sole determinant of the final fare for standard SPSV taxi journeys,
  • route selection (including toll or non-toll routes), traffic conditions, and waiting time may affect the final price, and
  • all standard taxi fares are subject to applicable NTA national maximum fare regulations and lawful SPSV extras.

Technical Non-Refundable Fee

Each booking processed through the LadyCab Platform or Dispatch System includes a €10.00 Technical Non-Refundable Fee per cab, regardless of the number of passengers.

  • Passengers may privately share this cost among themselves.
  • This fee is non-refundable once the booking is confirmed, except where a LadyCab vehicle is hailed directly on the street without using the platform.

Purpose of the Technical Fee

The €10.00 Technical Fee funds LadyCab’s operational-safety and service systems, including:

  • 24 / 7 trauma and incident-response unit;
  • panic-button integration;
  • continuous Garda-vetted driver verification;
  • bespoke vehicle-hygiene and inspection programme;
  • preferred-female-driver option (where available);
  • live GPS tracking with designated emergency contact sharing; and
  • bottled-water service.

These features form part of LadyCab’s enhanced safety and comfort service.

Passenger and Delivery Fares

(a) Passenger Transport – Standard Taxi Services All standard taxi passenger fares are calculated strictly in accordance with:

  • the taximeter installed in the vehicle;
  • the National Maximum Taxi Fare structure established by the National Transport Authority (“NTA”);
  • applicable extras and surcharges permitted under Irish SPSV regulations; and
  • any additional lawful charges including tolls, waiting time, route deviations, airport charges, luggage charges, or additional requested stops.

Passengers are responsible for confirming their preferred route (e.g. shortest, quickest, toll-inclusive, or toll-free route), as this may impact the final fare.

The final fare payable for standard taxi journeys shall therefore be determined by the taximeter together with any applicable lawful extras and regulatory charges in force at the time of the journey.

(b) Ladies Limousine Fixed Price Service LadyCab may offer a premium pre-booked service known as the “Ladies Limousine Fixed Price Service.”

For this specific service only:

  • the fare is agreed in advance between LadyCab and the passenger prior to confirmation of the booking;
  • the passenger is informed before acceptance that the service operates on a fixed-price basis;
    the agreed fare constitutes a pre-arranged, pre-booked, and contractually agreed fixed price for limousine or chauffeur-style transport services;
  • the passenger expressly acknowledges and accepts the agreed fixed amount before the journey commences; and
  • the agreed fixed fare shall apply irrespective of meter calculations, traffic conditions, or route duration unless additional services outside the agreed booking are requested by the passenger.

This service operates separately from standard taximeter-regulated taxi journeys and is intended to comply with all applicable operational requirements, exemptions, and prerequisites governing limousine and chauffeur services under Irish SPSV legislation and National Transport Authority (“NTA”) regulations.

LadyCab reserves the right to refuse conversion of a standard taxi booking into a fixed-price limousine service unless expressly pre-arranged and confirmed through the LadyCab Platform or dispatch system.

(c) Deliveries Delivery charges are calculated based on:

  • distance,
  • parcel size or weight,
  • urgency,
  • waiting time,
  • additional stops, and
  • any additional delivery-service requirements.

Adjustments may apply for delays, failed delivery attempts, or multiple collections/drop-offs.

In-App Card Processing Fee All in-app payments made by credit card or debit card through the LadyCab Platform are subject to a €1.00 card-processing and transaction fee per booking/order.

This fee:

  • is applied automatically at checkout;
  • forms part of the total payable amount; and
  • covers payment-processing, fraud-prevention, and transaction-handling costs associated with electronic payments.

Payments are securely processed through third-party payment providers, including Stripe or equivalent authorised gateways.

Payment Method

All payments must be made by electronic means approved by LadyCab (including in-app card payments or integrated third-party gateways). Cash payments may be permitted where allowed by law and LadyCab policy.

Payment is deemed complete once authorised by the payment processor.

Distribution of Payments

LadyCab acts as a limited payment-collection agent for Drivers, Delivery Persons, or Fleet Operators.

Payment by the Customer to LadyCab satisfies the Customer’s obligation to pay for the service. LadyCab distributes the relevant portion to the Driver or Fleet Operator, net of applicable fees and processing deductions.

Taxes and Licences

Each Driver, Fleet Operator, or Delivery Person is solely responsible for compliance with all applicable taxation, insurance, and licensing obligations.

LadyCab does not withhold or remit taxes on behalf of independent contractors unless required by law.

Changes to Fees

LadyCab may update fares, service fees, processing fees, or the €10 Technical Fee from time to time.

Updated rates will be displayed in the App or on the LadyCab website prior to booking.

The rates applicable at the time of booking will apply.

Cancellation and Amendment Charges

  • Cancellation after Dispatch: €5.00 charge applies once a booking has been dispatched. Waiting-time charges may apply where applicable.
  • Amendment within 30 Minutes: Changes made within 30 minutes of the scheduled pick-up time incur a €5.00 charge.
  • No-Show / Late Cancellation: The €10 Technical Non-Refundable Fee remains payable in all cases.

All charges are applied automatically to the Customer’s selected payment method.

Refunds and Adjustments

Refunds and adjustments are handled in accordance with LadyCab’s Cancellation and Refund Policy.

All disputes must be raised within seven (7) days of the transaction.

Non-Payment or Chargebacks

Failure to pay or initiating unjustified chargebacks may result in account suspension and recovery actions, including administrative and legal costs.

Business and Premium Accounts

Where applicable, additional terms and pricing structures apply and will be outlined in the relevant account agreement.

Receipts

A receipt will be issued after each completed journey, showing:

  • the final metered fare or agreed fixed fare,
  • the €10 Technical Fee,
  • the €1.00 card-processing fee where applicable,
  • any additional charges or lawful extras, and
  • the total amount paid.

14. Cancellation and Refund Policy

General Right to Cancel

Customers may cancel a booking at any time through the LadyCab App, subject to the conditions below. Cancellation charges are applied automatically to the registered payment method.

Cancellations made before a driver has been dispatched incur no fee, and any pre-authorised metered amount will be released by the payment processor in accordance with banking timelines.

After Dispatch

Once a driver has been dispatched, a €5.00 Cancellation Charge applies, equivalent to the minimum fare. If waiting time has begun, the regulated waiting-time charge will be added. This charge is deducted automatically from the registered card, electronic payment, or bill-pay account.

Pre-Booked Journeys

Pre-booked and paid trips that are amended or cancelled more than 30 minutes before the confirmed pick-up time are not subject to any penalty.

Where a booking is amended or cancelled within 30 minutes of the scheduled pick-up, a €5.00 Amendment Fee applies to compensate the driver’s committed time.

Technical Non-Refundable Fee

The €10.00 Technical Non-Refundable Fee remains payable in all cancellations and no-show events once payment has been processed. This fee covers LadyCab’s system and operational safety costs and is never refunded except where the booking was not made through the platform (i.e., a street hail).

No-Show and Driver Arrival

If the driver arrives at the confirmed pick-up location and the passenger fails to appear within the regulatory waiting period, the booking is treated as a no-show, and the applicable €5.00 Cancellation Charge plus the €10.00 Technical Fee remain payable.

Refund Process

Eligible refunds are issued to the original payment method within five (5) to ten (10) working days, depending on payment-provider processing times. LadyCab may request reasonable supporting information/evidence before authorising a refund.

Discretionary Refunds

LadyCab may, at its sole discretion, issue a full or partial refund where a verified service failure occurs (for example, vehicle breakdown before pick-up, duplicate charge, or proven system error). Such refunds do not set a precedent for future cases.

Non-Refundable Circumstances

No refund shall be due where:

  • the Customer breaches these Terms;
  • inaccurate pick-up details are provided;
  • the passenger is unprepared, disorderly, verbally/physically abusive or unavailable at collection time; or
  • the cancellation or complaint is raised more than seven (7) days after the transaction.

Refund Contact

All refund or cancellation queries should be submitted in writing to support@ladycab.ie, quoting the booking reference. LadyCab’s Support Team will acknowledge receipt within five (5) working days.

Performance will resume once the event ceases.

No Warranty

Except as expressly required by law, all services and software are provided “as is” and “as available.” LadyCab disclaims any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Severability

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions remain valid and enforceable to the fullest extent permitted by law.
